Joe Biden’s administration has been on the warpath against cherished freedoms.
But their latest unconstitutional scheme against law-abiding Americans was empowered by GOP turncoats.
And RINO John Cornyn handed Biden’s ATF this frightening power.
Republicans gave Joe Biden the biggest gun control victory in decades
The anti-gun lobby kicked into overdrive following the tragic school shooting in Uvalde, Texas, in 2022.
Gun control under former President Barack Obama ran into a brick wall because of the Senate filibuster.
This time RINOs in the Senate were all too eager to cut a deal to betray gun owners and hand President Joe Biden the biggest gun control bill in decades.
RINO U.S. Senator John Cornyn (R-TX) led the GOP effort, supported by Senate Minority Leader Mitch McConnell (R-KY) and Senator Mitt Romney (R-UT), to muscle through the 2022 Bipartisan Safer Communities Act (BSCA).
The BSCA included nearly one billion dollars for the Biden Justice Department to help Democrat prosecutors use red flag gun confiscation laws to violate due process, institute expanded background checks on gun buyers under the age of 21 – which Democrats are trying to expand to everyone – and increasing the number of Americans considered prohibited buyers under the National Instant Criminal Background Check System’s (NICS).
Cornyn worked with anti-gun U.S. Senator Chris Murphy (D-CT) to craft the bill and told gun owners that it was “good public policy” on MSNBC.
“We worked with the NRA to listen to their concerns,” Cornyn said. “But in the end, I think they simply — they have a membership and a business model that will not allow them to support any legislation. And so I understand where they’re coming from, but I think most people will not allow any outside group to veto good public policy.”
Cornyn’s Safe Communities Act became the first major gun control bill passed at the federal level since the 1994 so-called assault weapons ban under former President Bill Clinton.
RINO Cornyn empowering Biden to end private gun sales
Biden has been working to try and ban the private sale of firearms since he took office.
Thanks to the “good public policy” by Cornyn, his Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is trying to require gun owners to become federally licensed firearm dealers.
The ATF announced it’s using the Safer Communities Act to require that any sale or transfer of a firearm be run through the NICS system.
Selling a gun to a friend or passing down a firearm that’s a family heirloom from a parent to a child would require a federal background check.
This rule would make the private transfer of firearms so onerous that it would create a de facto ban.
And it would set the stage for an illegal universal gun registration system by tracking the transfer of virtually every firearm in the country.
The Texan pointed out that this unconstitutional assault on the Second Amendment was made possible, “under law from [Sen. John Cornyn], [The Justice Department] proposed a new rule that expands federal firearm licensing requirements. . .”

Called to a temporary halt
The good news is ATF has been temporarily halted in implementation of its “engaged in business” rule thanks to a federal judge’s intervention.
Last month, U.S. District Judge Matthew Kacsmaryk issued a preliminary injunction that whalloped the Biden ATF for its vast overreach in issuing the “engaged in business” rule. In a 21-page opinion, Kacsmaryk ruled the ATF violated rulemaking procedures. In his opinion, Kacmaryk said the rule was not only arbitrary and capricious but also put law-abiding, average citizens at risk of going to jail.
Kacsmaryk specifically called out the Cornyn-pushed BSCA in his opinion, noting contradictions that put gun owners in an impossible position.
“Other Plaintiffs face both civil and criminal enforcement actions for engaging in conduct that the BSCA permits but the Final Rule impermissibly forbids. They cannot engage in lawful, noncommercial conduct without fear of prosecution. They cannot collect firearms for personal defense while enjoying statutory protection. Nor can they dispose of firearms from their personal collections for fear of being presumed ‘engaged in the business,’” Kacsmaryk stated.
Unfortunately, the injunction is only temporary, and Biden ATF lawyers are sure to be back and won’t give up fighting until they get their way or are stopped by higher courts. Even then, they’ll surely come back with slight modifications to try to sneak their dangerous power grab around judicial review.
