Biden’s ATF illegally imposes universal background checks
Anti-gunners have had a long-held dream of imposing universal background checks on all firearms transferred in the country.
The 2022 bipartisan Safer Communities Act championed by RINOs like U.S. Senator John Cornyn (R-TX) and Senate Minority Leader Mitch McConnell (R-KY) opened the door for that to happen.
Biden’s Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) cited the authority in the law to regulate gun sales to redefine who is a firearms dealer.
The ATF changed the definition of who is “engaged in the business of selling guns” to include virtually all private firearms transactions in the country.
Selling a gun to a friend or passing down a gun from father to son suddenly became considered a commercial activity under federal law.
Private transfers would now require the person transferring the gun to run a federal background check on the FBI’s National Instant Criminal Background Check System (NICS).
A private seller would be treated like a gun store and be required to run the name of their buyer through the NICS system.
This would turn someone who sold a shotgun to a hunting buddy into a felon for not running their name through NICS.
This red tape and expense would wipe out the vast majority of private firearms transactions in the country.
And it created a backdoor to mass gun registration by forcing almost every private firearms transaction into the NICS system.
John Kennedy fights back against the ATF’s universal background check rule
U.S. Senator John Kennedy (R-LA), along with more than 40 Senate Republicans, introduced a resolution under the Congressional Review Act (CRA) to block the ATF’s new universal background check rule.
The CRA allows Congress to overturn regulations issued by federal agencies with a resolution that’s not subject to the filibuster.
“The Biden administration is weaponizing every tool at its disposal against law-abiding gun owners,” Kennedy said. “Congress should vote to block Pres. Biden’s ATF from unconstitutionally creating new ways to strangle Americans’ Second Amendment rights.”
Representative Andrew Clyde (R-GA) – a Georgia gun store owner – introduced the companion resolution in the House.
“The ATF’s ‘engaged in the business’ rule represents President Biden’s latest attempt to institute universal background checks, advance the Left’s radical gun control agenda, and infringe on Americans’ Second Amendment rights,” Clyde said.
“Private citizens simply shouldn’t be forced to jump through unelected, anti-gun bureaucrats’ unconstitutional hurdles to engage in lawful firearms transactions. I look forward to leading this critical CRA in the House, and I urge my colleagues in both chambers to support our measure to stop the Biden Administration’s tyranny in its tracks,” Clyde added.
The ATF rule is also facing multiple lawsuits in federal court for sidestepping Congress with the rule.
